Welcome to Glow by Beauty Avenue. These Terms of Service ("Terms") govern your use of our website at glowbybeautyavenue.com, your purchase of products and services from us online or in our studio, and your booking of appointments with us.
By using our website, booking an appointment, or making a purchase, you agree to these Terms. If you do not agree, please do not use our website or services.
1. Who we are

2. Our services are aesthetic
The treatments and products we offer are aesthetic services intended to support the appearance and feel of your skin.
Nothing we provide is intended to diagnose, treat, cure, or prevent any disease or medical condition, and nothing on our website is medical advice. Our services are not a substitute for care from a physician, dermatologist, or other licensed medical professional. Please consult a medical provider for any condition that requires medical diagnosis or treatment.
Individual results vary. We do not promise or guarantee any particular result, outcome, or timeframe from any service or product.
3. Eligibility
You must be at least 18 years old to purchase from this website or book an appointment on your own behalf. Clients under 18 may receive certain services only with the consent of a parent or legal guardian, who must be present and sign the applicable forms. Some services are not available to minors.
By using our website, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these Terms.
4. Appointments and bookings
Booking
Appointments may be requested online, by phone, or in person. A booking is confirmed only when you receive a confirmation from us. We may require a card on file or a deposit to hold an appointment.
Cancellations and rescheduling
Please give us at least [24] hours' notice to cancel or reschedule. Cancellations with less notice may be charged [50%] of the service price. Missed appointments may be charged [100%] of the service price or may forfeit one session from a package. Full details are in our Cancellation Policy.
Late arrival
If you arrive late, we may need to shorten your service so the next client is not delayed. The full service price still applies.
Our right to decline or stop a service
Your safety comes before a completed booking. We may decline, pause, or stop a service at any time if we believe it would be unsafe for you, if you disclose or we identify a contraindication, or if our staff are treated abusively. You are not charged for a service we decline on safety grounds.
Your responsibility to disclose
You must complete our intake form honestly and completely, and tell us before each visit about any change in your health, medications, recent procedures, or pregnancy status. We rely on this information to keep your treatment safe.
5. Consent, waivers, and releases
All treatments require you to sign a consent form, waiver, and release before service. We cannot perform a treatment until these documents are completed and signed, and they must be reviewed and updated at each visit as needed.
These documents are part of your agreement with us. Where a signed consent form, waiver, or release conflicts with these Terms, the signed document controls for that treatment.
6. Packages, series, and gift cards
Packages and series. Prepaid packages are valid for [12] months from the date of purchase and are non-transferable unless we agree in writing. Sessions remaining after the expiration date are forfeited unless otherwise agreed in writing. Packages are non-refundable, whether used or unused.
Gift cards. Gift cards are redeemable for services and products at our studio. They are not redeemable for cash except where required by law, and are not replaced if lost or stolen. Gift cards do not expire and are not subject to service fees, as required by Texas law.
Memberships, if offered, are governed by the separate membership agreement you sign at enrollment.
7. Products, orders, and shipping
Pricing and availability
We make every effort to display products, descriptions, and prices accurately, but errors can occur. If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse the order, even after it is confirmed, and will refund any amount charged.
Products are subject to availability. We may limit quantities or discontinue a product at any time.
Orders
Your order is an offer to buy. We accept it when we send a confirmation or ship the product. We may refuse or cancel any order.
Payment
Prices are in US dollars and exclude applicable sales tax, which is added at checkout. You authorize us to charge your payment method for the total amount of your order, including tax and any shipping charges.
Shipping and risk of loss
Shipping timeframes are estimates and are not guaranteed. Risk of loss passes to you when the carrier takes possession of the product. Full details are in our Shipping & Returns policy.
8. All sales are final
All sales are final. We do not offer refunds on any service, package, gift card, or product.
This applies to services performed, prepaid packages and series whether used or unused, gift cards, and all products purchased in our studio or online.
Damaged or defective products. If a product arrives damaged or is defective, contact us at support@glowbybeautyavenue.com within [7] days of purchase or delivery with your proof of purchase and photographs. Where the product is confirmed damaged or defective, we will arrange a replacement. This does not affect any rights you have under applicable law that cannot be waived.
If you are unhappy with a service, please contact us within [7] days. We want to know, and we will work with you to address your concerns, though this does not entitle you to a refund.
Please ask us any questions you have before you purchase or book, so you are confident in your decision.
9. Devices and product use
Devices and skincare products sold by us are intended for personal, at-home use in accordance with the manufacturer's instructions and any guidance we provide.
You agree to read and follow all instructions, warnings, and contraindications supplied with a product or device, to stop use and contact a medical professional if you experience an adverse reaction, and not to use a product or device on anyone else in a professional or commercial setting unless expressly authorized.
Manufacturer warranties, where they exist, are provided by the manufacturer and not by us. We pass through such warranties to the extent we are permitted to do so.
10. Promotions and discounts
One promotional treatment offer per person, per year. All treatment promotions, whether advertised through online marketing, social media, email, or physical signage at our location, are limited to one redemption per person in any twelve-month period. This limit applies per individual, not per offer, so redeeming one promotional treatment makes you ineligible for other treatment promotions for the following twelve months. Promotional offers are for new or returning individual clients and may not be shared, transferred, combined, or split between people or households.
We may ask for identification to confirm eligibility and may decline a promotional booking where this limit has already been used.
Promotions, discounts, and special offers are valid only for the period and on the terms stated, cannot be combined with any other offer unless we say otherwise, and have no cash value. We may modify or end a promotion at any time.
11. Website use
You may use our website for lawful personal purposes only. You agree not to:

- Attempt to gain unauthorized access to our systems or interfere with the site's operation
- Use automated tools to scrape, copy, or collect content or client information

13. Reviews, photos, and submissions
If you post a review, comment, photograph, or other content to us or about us on our channels, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business.
Photographs taken during your visit are governed by the separate photography and media release you sign with us. We will not use images of you for marketing without that written permission.

Our Privacy Policy explains how we collect, use, and share your information, and it forms part of these Terms.
15. Disclaimers
Our website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any content is complete, accurate, or current.
Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including under the Texas Deceptive Trade Practices Act.
16. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms, our website, our products, or our services shall not exceed the amount you paid to us for the product or service giving rise to the claim.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill.
Nothing in this section limits liability for gross negligence, recklessness, intentional or willful misconduct, or any other liability that cannot lawfully be limited.
17. Indemnification
You agree to indemnify and hold harmless Beauty Avenue LLC, its owners, members, managers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the website, your inaccurate or incomplete health disclosures, or your failure to follow instructions provided with a product, device, or treatment.
18. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Exclusive venue and jurisdiction for any dispute arising from or relating to these Terms, our website, our products, or our services lies in the state or federal courts located in Gillespie County, Texas, and you consent to personal jurisdiction in those courts.
19. Changes to these Terms
We may update these Terms at any time. The updated version will be posted here with a new effective date, and applies to your use of the website and any purchase made after that date. Your continued use of the site means you accept the updated Terms.
20. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Our failure to enforce any provision is not a waiver of our right to enforce it later.
